What Information is Collected and for What Purpose
When using the Software owned by BEFECTIVE BRASIL LTDA, personal information is collected when you become our customer, employee, partner or supplier; subscriber to our newsletter; fill out our forms; request technical support; or talk to us through our service channels and instant messaging applications, with full respect to the precepts contained in the General Personal Data Protection Law (LGPD).
When you wish to receive information about our products and services, we ask you to provide your email address, name, phone/mobile number, company and position. When contracting our services, you must also provide financial data, billing address, phone number or other relevant information for invoice issuance, as well as essential data for creating a contract and issuing an invoice.
To provide the best service and fulfill our purpose as performance management software, BEFECTIVE collects from Users statistical information and URL usage, software name, programs used, start and end time of work.
BEFECTIVE is a service provider, therefore, we may have information about you in our database that has been collected by our clients. In this case, we have no decision-making power over this data, where we act as Processor and process what is requested by the CONTRACTOR, who in this case assumes the role of Controller.
BEFECTIVE, although it may have access to the CONTRACTOR's users' data, does not collect, process or have contact with or access to any sensitive data.
BEFECTIVE uses the data received EXCLUSIVELY to carry out the provision of contracted services, without carrying out enrichment, sale, or any other act different from that indicated in this Privacy Policy.
The data collected by BEFECTIVE will be kept for the duration of the contractual relationship between the companies, and will be deleted in case of contract termination.
Finally, when you access our website or system, we may also collect information such as: your browser type, user's computer IP address, date and time of access. This information can be aggregated to measure the number of visits, average time spent, page views and other statistics. We use this data to monitor the performance of our services and to implement improvements.
Communication and Security

- BEFECTIVE may use the collected data to improve security and enhance services for the CONTRACTOR and its Users. In this way, we can analyze and solve technical problems, as well as identify and prevent fraud in the use of our Service.
BEFECTIVE is not responsible, either directly or subsidiarily, for the misuse of the Platform by the CONTRACTOR and its Users, as well as for the actions carried out by them.
In case an Employee is terminated from the CONTRACTOR, it is the responsibility of the latter to deactivate the User on the platform, or immediately inform BEFECTIVE Support:
International Data Transfer
Security and prevention are critical principles to ensure the privacy of the Data Subject. Data held by BEFECTIVE will be shared with sub-processors in another country under the following conditions:
- The country is classified with an adequate level of data protection; or
- The transfer is authorized by the National Data Protection Authority.
Privacy Policy Updates
BEFECTIVE always seeks to improve its software to ensure the best service and platform protection, although, eventually, this Privacy Policy may be updated or modified unilaterally by BEFECTIVE.
Such changes/updates will always be communicated to the CONTRACTOR and its Users, who will always be guaranteed the option to cancel the contract, at any time, if they do not agree with the new terms and policies.
Privacy Policy Validity
The Privacy Policy of BEFECTIVE software comes into effect from the moment the CONTRACTOR signs the service provision contract.
The validity of this Privacy Policy will be for an indefinite period, in force for the duration of the contractual relationship between the parties and the duties arising from it.
General Personal Data Protection Law (LGPD)
The LGPD is the regulation that governs the processing of personal data, including in digital media, by a natural person or by a legal entity governed by public or private law, with the aim of protecting the fundamental rights of freedom and privacy and the free development of the personality of the natural person.
The processing of personal data (information related to an identified or identifiable natural person) that BEFECTIVE carries out has specific needs and purposes for the provision of services, as already demonstrated above, also respecting free access, security, transparency and all other principles listed in the law, after all, our greatest value is our customers.

General Provisions
The CONTRACTOR and its Users declare that they agree and undertake to comply with the guidelines and provisions established in this BEFECTIVE Privacy Policy.
This Privacy Policy, for all legal purposes, is an integral and inseparable part of the BEFECTIVE Software Use License contract as an annex.
BEFECTIVE is not responsible for damages and/or problems resulting from delay, interruption or blocking of data transmissions that occur on the Internet.
The parties recognize and declare that there is no employment, associative or corporate relationship between them, their employees, agents or service providers, directly or indirectly involved in achieving their purpose, so any agreement, misuse, improper use of information by users within the platform does not concern BEFECTIVE, being the entire responsibility and relationship of the CONTRACTOR and its users.
